How Long Do I Have To Claim Compensation?

Unfortunately, there is a legal time limit in place for when it comes to claiming compensation.

Generally, you will have 3 years from the date of the accident to make a claim.

So if you suffer an injury on 10th August 2023, you’ll have until 10th August 2026 to issue court proceedings.

If no claim is made by this time, you may be prevented from claiming altogether.

There are some exceptions to this rule. For example, in cases of medical negligence the time limit can go by something called the data of knowledge, which is the date upon which you gain knowledge that your illness or injury was caused by the failings of a healthcare professional.

There are also exceptions when it comes to children (under the age of 18). In the eyes of the law, a minor cannot represent themselves. As a result, the time limit is frozen until they turn 18. It then runs until their 21st birthday.

However, a litigation friend can make a claim on their behalf at any point before their 18th birthday, with any awarded compensation held by the courts until the claimant comes of age.
